I am writing this letter on memorial day, a day to celebrate our freedom as a nation . On Tue. June 8, we have a primary election for Sheriff of Ravalli county. This is one of the most important races any of us can vote in. Whoever becomes our next Sheriff will determine how much freedom and civil rights we will have here in this county.

For the last 12 years we have had outrage after outrage, 1/2 pound of cocaine missing from evidence room, jail suicides, deputies using the Sheriff's computer to access pornography,wife beating drunks hired to police us.

Thousands of dollars worth of ammunition stolen right under the Sheriff's nose.

Citizens complaints thrown in the waste basket and never an answer. Its almost impossible to get a copy of a police report with out endless red tape.and endless waiting. We must change things in Ravalli county.

We need professional law enforcement in Ravalli County. I am voting for Joede Vanek a tried and true police professional with 20 years experience and advanced training who can inspire and teach our deputies to be professional peace officers.

When you dial 911 who do you want to show up, a bully with a badge and a gun or a professional well trained peace officer? Its your choice.

At the present time you are better off dialing-a-prayer than 911.

2. Sheriff Chris Hoffman is lead Defendant for millions in civil liability to Ravalli County by incompetent leadership, and at times intentionally violating protected civil rights. We all pay for Chris Hoffman’s mistakes and his violations to the oath of office.

1. Hoffman’s deputies voted no confidence in his abilities before the 2006 election, in 2007, 75 voters signed a recall of Hoffman in Ravalli County. It’s time for a new Sheriff, Bitterroot Valley. We are not safe with Hoffman in office. ""

Keep in mind folks some from Eureka went to Testify in Helena this bill and the self defense bill before the house judiciary committee. It is said that There were about 40 supporters there that day and that only about 7 were there against the bill.

The President Letter from Roy P. Pilkey was banned from the Bitterroot Public Library as well as the requestor recently. Upon finding the American Library Association (ALA) they have a "Library Bill of Rights" which apparently Gloria Langstaff (director) feels does not apply to her library. Ms. Langstaff will make an appointment with the public, then ban them from the library, so to not uphold the meeting scheduled.

Montana Law is very specific: a library director has no power to take library access from a patron. Only in Hamilton, Montana does the Police and the Library director work together to commit crime.

according to Justice Brennan former US Supreme Court Justice: "Even the slightest redeeming social importance--unorthodox ideas, controversial ideas hateful to the prevailing climate of opinion..." was protected by the first amendment. BUT NOT AT THE BITTERROOT PUBLIC LIBRARY!

No policies regarding behavior are listed on the website: http://www.bitterrootpubliclibrary.org/ nor was any requests made to leave the library, or stop behavior.

Perhaps they are protecting the public officials who are violating our rights, and the public needs to take back their library, as well as local government, and law enforcement. We do this by running for & holding public office.

Please note: The Bitterroot Public Library will open late October 29, 2009 due to the need to train the staff on appropirate interactions with the public. They plan on learning on when not to call the police when a patron is peacefully assembled on the public property.

The director will learn Montana Law, knowing that an advanced degree is required (which she does not have).

UPDATE: We had a sighting of Gloria Langstaff, it looked like she did not see the light of day much. It comes at no wonder that the board lets her do as she pleases, she looks like one mean Bat. The other librarians in tow, looking extra special "going after" someone who was minding their own business, speaking or bothering no one, did not get asked to leave the library, and the director did a "positive identification" on the offender, executed a call into the Select Committee on Election: The Hamilton Police Department.

This is not a joke. We ask that those who wish to test their luck with fate, like the running of the bulls in Italy, ask for the President's letter from the front desk. If you can survive for 8 seconds, you can have a membership at this wonderful 1 room library. Embezzlement is amongst the fun we have in Hamilton, Montana at the "free" library.

Free to tax the county excessively, use volunteer labor, take estate gifts, and get free accounting, and lease (sorry, $1/yr) from the City of Hamilton. Maybe they should have been friendlier to a candidate for the office of Mayor. Once again, please stand by for our feature film documentary due out in September. BPL is toast. This of ccourse is a figurative statement.

Thank you for the defamatory comments on the August minutes Ms. Langstaff; these were published for 5 days on the BPL homepage. We wonder why you pulled them after our letter was delivered to the NEW chairman. Ask Donald Trump: YOU'RE FIRED!

We the People of Montana have made initial steps to request ACLU vacate the State of Montana. False advertising claiming to stand up for first amendment rights on Montana Public Radio advertisements. ACLU-MONTANA can find some other boobs to believe them. In another state.

More updates: A prison library was set up by a church in Arizona within 6 months which had more books (donated), and a bigger space than the BPL; with volunteers!

The Bitterroot Public Library violates right to assemble, speak, to read, and enjoy a state sponsored right of a "free" library. The "5-year plan" includes:
expanding the 'program area' (this is the "romper room" area) for the children
is signed by departed chair Ellyn Jones and Gloria Langstaff on 2/17/07
The Bitterroot Public Library seems to not be interested in books, or adult learning.

The State of Montana has a library governing document which states that all policies are available to the public as per Administrative Law. Ms. Langstaff informs the Hamilton Police and brings banned books to them.

As per the ALA guidelines, no librarian can censure material from a viewer, or potential reader if not profane nor obscene. The "right" to read, the "right" to view (see http://www.ala.org/ ) has been violated by the Bitterroot Public Library Director.

If the first amendment is not important to our library director, we have found a new area to request our rights. Freedom of speech is being taken by our own public officials in a manner that is consistent with "organized" crime; prearranged understanding and involvement with local law enforcement.

The Bitterroot Public Library would rather keep their '08-09 budgeted $611,000 in the bank of taxpayer money (budget year '09-'10 has $513,000--so where did $100,000 go?).

The Bitterroot Public Library would rather not uphold their own policies, not provide any policies to the public, and be exclusive about what materials come into the library. No public service standards apply, nor any American Library Association guidelines and procedures. The public in the Bitterroot Valley deserve better, it will be so soon. Please run for County office----see the ELECTIONS PAGE for details.

These are our public officials, not answering to the public; making their policies public nor accessable, and not using our tax dollars appropiately. This is why we need to change our Valley by electing public officials who will work for us, instead of a "group", or themselves.

We the People will gladly add the Bitterroot Public Library as an entity that has refused to uphold freedom of speech, or Montana Law.

These are specifically spelled out in a Montana Library guidance document says must happen. An exemple of public officials acting outside the law. We will clean up our community, one vote at a time. ""

Beneath the Beauty - Montana Documentary on Hamilton Montana Issues - The Letter Banned from the Bitterrroot Public Library in Hamilton Montana.

Since the Documentary www.BeneathTheBeauty.com has come out many have asked me questions on the Hamilton Library and what the Big Deal is with Some Letter Not being Allowed in the Library, and Why the Guy Running for Mayor at the Time, Michael Spreadbury was being seemingly harassed by local police for wanting some letter open to the Public at a Public, Government Funded Library ?

So I Want to Post that Letter and a Link to the Site that the Letter to the President of the United States is Posted on.

Sir,

I write to you with respect, admiration and hope. In this time of our nation’s strife, I do not ask for monetary relief or a bailout. Sir, I have lost everything that I hold precious in life, I live in Ravalli County, Montana. There are no civil rights here, there is no justice here, and there is no one to appeal to. I want my human rights, and my freedom back.

I am 67 years old, I was raised in the Navy, and served in the USCG for four years, I served 25 years in the Seattle Fire Department where I retired on 9/11/91. I have served my country my entire life and I still abide by the oath’s that I swore to defend my Flag, the President, and to serve the American People, as did my Father.

Sir, I moved to Ravalli County, Montana in April of 2002. After 911 I wanted to try and start over as I felt that my time of usefulness had passed. Fate works in strange ways and my duty as an American was to be tested like never before. I found myself in the midst of ignorance, racism, hate crimes, nepotism, and corruption, where the weapon of choice for criminals is the American Flag.

I fight for America Sir, and now the rumble has reached the White House. The horses hitched to your wagon have brought you into it. The truth shall set us free.

I present to you the “unbelievable” daily life of American citizens in the Ravalli Territory, the Holy Grail of injustice in America:

Montana is the third largest state in the lower 48, yet has a population of less than one million residents. It has three electoral votes with one Congressman and two Senators. There are 56 counties distributing the power of the United States Constitution.

The present Governor of Montana states that “Montana is for Montanans”, and openly mocks the government of the United States. I am an American, not a Montanan.

Ravalli County starts at the Idaho border to the South, runs the length of the Bitterroot river, with the Bitterroot Mountains to the West, and the Sapphires to the East. There is one road, Highway 93, in or out. No news goes out and very little comes in as we have no Newspaper, and one radio station. It is isolated and remote.

The County Government is the cow that feeds it. It offers jobs to those who are willing to buy in. All others are treated as “illegal aliens”.

The County Attorney is an all powerful entity, above the laws of the United States, openly protected by the State and our National Representatives. Ravalli is a micro climate set up to set the standard for the rest of the state. It can be compared to a “black hole”. Seventy percent of Ravalli County is Federal land. This is a Third World Country within the State of Montana. No person or entity can, or will claim jurisdiction here. Is this the template for the new America?

Very few people in this state go unaffected or untouched by these events of violation.

The last Census said there were approx 37,000 residents, of which 29,000 are of voting age. Amazingly all of them are “registered voters”. The Secretary of State claims to have very little control over voting laws in the county. They are defined by the County Attorney as to who shall , or shall not vote, and what they may, or may not petition.

The County Sheriff is an elected official and is the head Law Enforcement Officer in the County. There is no criteria to be the Sheriff.
The current Sheriff received a unanimous vote of “no confidence”, from his department and yet was re-elected. Any group will only be as good as it’s leadership.

There are five elected County Commissioners, all paid.
They have no say over the County Atty (CA) , or Sheriff. The CA regularly overrules any legislation they try to pass regarding zoning or permitting. They are pretty much powerless, with main emphasis on who shall sit on county boards.

The City of Hamilton is the County seat. There are less than 4,000 people living within the city. They have 6 city council seats, an all powerful Mayor, a city Judge, and a Justice of the peace, all of whom are elected. There is no City Treasurer although the citizens passed a petition to have a Treasurer.

The words “and to the Republic”, mouthed by these officials during the “Pledge of Allegiance”, refers to the local newspaper.

The City Attorney, works under contract, also acting as prosecutor. This attorney worked for almost 6 years without a contract, and never swore an oath of office at any time.
This is a blatant violation of State Law.

His comment about that is, “ it is ridiculous to think that I should have to swear an oath”.

The State bar, and the District Court Judge, said it was ok to violate state law and swear the oath 6 years later. The Court system prides itself on very tough justice with a 90 percent conviction rate of violators of the law. All judges and city attorneys are former prosecutors for the County.

Hamilton Police Department has a force of fifteen officers.
A normal town has one officer per thousand population. They have the run of the County as their jurisdiction. They have been out of control for a very long time. The “tail wags the dog” here. They are almost all of “local flavor”.

The Police Chief acts with impunity to any authority including, county, state and federal.

The City of Hamilton is not incorporated.
City limits were never established; no census of the population was ever taken, and there was no election held by those citizens to establish the “City of Hamilton”. Therefore, what is the legal standard and criteria by which this illegal group administers, executes and prosecutes the laws of the State and Constitution of the United States.

How can they issue permits and tax the people?

How can they be allowed to hold elections for a nonexistent entity?
The County Attorney claims he has no authority in issues within the city of Hamilton. People within Hamilton may not vote on county issues by order of the County Atty. The Sec of State has no record of Hamilton, Montana therefore no controls regarding voting.

The Fire Department claimed by Hamilton is an all volunteer group of 20 Fire Fighters, none of which are paid. Their services are minimal, and there is no standard or criteria as to qualification or training. They are an entity separate from the city.
They are the First Responders to the NIH Rocky Mountain Lab a level four biolab. There is no way these men should be expected to cover this facility. RML gives a grant to the HVFD to buy a 100 foot Aerial Platform, surely the most useless piece of equipment they could have. There is no one who knows how to drive it, and no where to park it. There are no buildings over 3 stories in the county or city.

The Fire Chief quotes to me, “we need the Aerial Ladder so there are no ground ladders up when the walls collapse”. There are no paid fire fighters anywhere in the county that I know of.

NIH has put science before the safety of American Citizens.

This county would be an excellent place to move Guantanmo. There is no escape, no rights and no one to complain to.

However, the rest of the world might regard it as “cruel and unusual punishment”.

In 2001 three women are killed in a Florence, MT beauty salon in broad daylight, The case remains unsolved.

In 2002 a Hamilton officer shoots and kills a man involving a domestic dispute. Six months later a coroners (a former Hamilton City Police Officer, and current Sheriff) inquest finds it justifiable.

In 2002,the State loses it’s viable Power Company which was publicly owned. Jobs, pensions and a public utility all are shuffled and sold. This was considered business as usual here with no investigation by the State or federal government.

In October of 2005, a man has barricaded himself in a gas station convenience store at the edge of town after briefly holding the employees hostage. His white pickup truck, a second male passenger, and a large white bag on the ground are left in a driveway around a corner from where the man has fled.
The owner of the home asks the remaining man if he is ok and the man says, “yes, but my buddy is really messed up“.

He walks around the corner and watches with the Police.

Quite a while later the home owner watches a third man pick up the bag on the ground, toss it into the truck and drive off.

Law enforcement from all over Western Montana have surrounded the station, blocked off the highway, and wait for over 9 hours before attempting to enter. The Hamilton Police chief is in charge of the scene.

They find the man has killed himself in the bathroom. He has a briefcase containing $4000 dollars he had robbed up in Flathead County. The News Media had covered the episode from the earliest minutes and report a sad but successful end to the story. Law enforcement are commended for their good work.

There is no mention of the second man or the money. Two days later, the Ravalli County Sheriff’s dept shows up at a residence at the end of a road about 10 miles out of town and wants to know where the missing $200,000.00 from the robbery is?

The residents are dumbfounded to learn that the truck used in the robbery has turned up abandoned on their property. No mention of this has ever been made public that I know of. The witness where the truck originally stopped is advised by a state official to keep her mouth shut.

Within a six month period in 2005, five inmates hang themselves in the Ravalli County Jail. A coroner’s inquest finds everything ok.

What could cause such desperation of these men, to take their own lives. Who were they?

What had they done? There was never a trial or question of who and why.

Death at the hands of law enforcement
is taken for granted as “normal” in Montana.


Several jail employee witnesses are terminated.

There are survivors who lost their loved ones, fathers, sons, and friends. There are those that know the truth and must live with it. There are those that must cover up the truth further enlarging the ripple and the quicksand trap it feeds.

The Police chief retires from the City dept to take a job with the NIH Rocky Mountain lab. The lab turns down very qualified people for administrative and security positions keying for what they describe as “local flavor”.

They hire the City Administrator, along with the Police Chief. The closest professional help for any emergency is in Missoula, at the least, 90 minutes away. The same campus in Bethesda, MD has a 30 man fire department covering their lab.

The 20 Hamilton Volunteers are neither trained or qualified to address any part of an emergency within this facility and should not be asked to do so. Certified letters sent to Bethesda regarding this situation have disappeared. NIH security is often seen patrolling the streets of the city.

The District Court Judge for Ravalli County is pulled over by Hamilton Police and charged with DUI.

He is ticketed and booked. His story is spread all over the “Ravalli Republic”. He is pulled over again in Missoula and charged with the same thing. He admits to a problem, says he will go through the rehabilitation and is allowed to keep his position. The Officer doing the initial arrest will be referred to as “not so super“, Notso.

The officer often testifies to the Judge, along with the Hamilton City atty who doesn’t think the Oath of office means anything. The Montana Disciplinary Committee, aka Bar Assn, says “no problem”. This man had once been a respected and trusted Judge, now his opening line must be “How may I please the state”?

The local daily newspaper, the Ravalli Republic is owned by Lee Enterprises. It is totally controlled by the County attorney here, and all of it‘s other publications will only print the party line. Falsehoods causing much grief to innocent people are regularly published, yet retractions and other viewpoints are staunchly avoided.

Any innuendo that something is foul in Montana is rewarded with a “fuzzy bunny” story as the County Attorney, and other State Officials reminisce of happy times in their rise to success . Made up “awards” and plaques are given with accolades to Police Officers, and their leaders for their “humanitarian” work.

There are few, if any newspapers in Montana which are not owned by Lee. I would liken it to Pravda.

A retired Army Veteran is parked in front of his Physical Therapist office in the middle of downtown Hamilton in the afternoon.

He is waiting for his appointment time. He looks up to see a gun pointed at him in the drivers side window. There are three more Hamilton Police officers in position with guns pointed , demanding he get out of the car.

He gets out and is braced and searched. He finds out that he is suspected of being a terrorist shooter because he is wearing a leather vest. He is told to watch his step.

In 1949, I recall having a butterscotch sundae with Mr Watling, at NAS Niagara where my father was stationed. He was a Navy jet pilot and he was leaving for Korea. I don’t remember what we talked about except that he had noticed my “cub scout hat”, and that he seemed pleased to be with me.

I can never forget the respect, that my father showed him at our introduction. The newsreels at the movies were never the same when I found out that he wasn’t coming back. I was probably his last memory of America. I learned early the responsibility of my heritage.

A young HPD Officer is appointed by the unincorporated Hamilton City Council to be the new Police Chief in spite of pressure by community leaders to get an outside professional for the position. The force now numbers 15.

A normal city will have one officer per 1,000. Hamilton has less than 4,000 residents. On any given night the town lights up like the Aurora Borealis with blue lights flying everywhere. It appears that the tickets are the towns only income. One rookie officer sets the record with over 100 unsupervised arrests and is applauded for his wonderful work.

At the end of his year probation, he swears the ” oath of office”. He regularly holds “show and tell” with other citizens showing the actual videos of his arrests with commentary about the victims. These officers carry real guns with real ammunition, they are brandished regularly.

Sir, with your connections, could you get Supercop, a few days of duty on the streets of Chicago? Better yet, let’s just swap departments for about a week.

A retired decorated LA Police Officer, who was disabled after being run down by a murder suspect lives here. He is a former United States Marine who has served abroad, and willing community volunteer. He joins up with members of the USMC Band who are performing at the County Fair. He attempts to give some of them a ride, when after pulling out of his parking place, he is pulled over by “Supercop”.

He is accused of cutting in front of the police car and DUI. Supercop gives the “Mic on, Mic off”, routine to the flustered veteran, and writes him a serious DUI ticket. The Vet is devastated and seeks counsel outside of Ravalli County.

The attorney urges him to plead “per seand take the consequences, as he says the “police there, will lie”. The Vet does as urged and has the book thrown at him by the Hamilton judge who is a former Marine adjutant proud of the harsh sentencing handed out in Hamilton.
He is devastated and embarrassed. He goes to his health club, and there Supercop and others openly and publicly mock him.

The man resigns from the health club and has to see a shrink to get his health and composure back. The Vetcop is pulled over months later for DWIH (Driving While In Hamilton), and the officer immediately goes to the mans license tabs where he finds that the “numbers don’t match”; amazing police work.

This place is a vipers nest where honest, good people are not welcome and openly discriminated against. Like all of us, he is wounded and will never be the same. He has lost his faith in America.

Is this the greeting returning vets shall receive? Is this what we all served for? Is this the legacy for our children?

A Native American man is shot and killed in Darby by the town Marshal. The Marshal has been notorious for ticketing a very famous late night talk show host and for anally tight law in his town, which is referred to as “camera land”.

Fines are payable then and there.

He responds alone to a domestic dispute and gives a pat story the night of the shooting . It was portrayed that he had responded to the place and was immediately jumped by the man, whom he knew well. While fighting to keep his gun away from the man, he shot him twice.
This was all over the news that night and the next day. When relatives showed up, they found the girlfriend was under arrest in the hospital, and there was reportedly another witness.
The Marshal was wired for tape.

Six months later, during a Coroner’s inquest, a new version of the story unfolds where the witnesses could not remember anything , and parts of the tape are blank. The last words you hear are the Marshal stating that he was going to shoot the man, and then he does. The death is found justifiable.

I ski in the winter and often ride the chair with students up for the day. One young man is always dressed in dark blue and never without a ski mask on. I have talked to him several times and learn he is a home school student from Darby.

One day he tells me that it is his birthday and that he just got an assault rifle with a stainless steel barrel that wont wear out. He wants a pair of twin tip skis like mine so he can ski backwards and shoot.

“I am very seldom at a loss for words”.

While serving in the USCG, I spent a year of isolated duty on an island in the Aleutians. After a while you lose the perspective that there really is anything outside of where you are. People who have been in combat or taken long sea voyages will give you the same comparison.

Hostages tend to accept and sympathize with their captors and go along with it as a survival instinct. You do whatever it takes to fit in. I believe it is called “Stockholm Syndrome”. It is a very necessary trait one should have to live in Montana. ""

Ravalli County Undersheriff McConnell has committed felony partner assault on his spouse.

We ask the Supporters of Abuse Free Environments (SAFE) give support to a cracking RCSO. Their #2, Undersheriff McConnell has committed felony partner assault on his spouse, and reportedly is incarcerated. Here is an example of a department in real trouble, and the public should note they are operating on a short fuse. Further proof that a local press is paid to keep this quiet (see Ravalli Republic page) we have no information from the press on this assault. After the news is a week old, we get an article in the Republic.

"We the People" are a non-violent, proactive group to bring justice to the people of the Bitterroot Valley. We state this on our "non-violence" page at www.mtjustice.info website. We do not languish in the demise of the RCSO, we are hopeful that a better qualified Sheriff, and Municipal Police Chief in Hamilton will foster better service to the people of the Bitterroot Valley after they are replaced in upcoming years. Ex-sheriff becomes Ravalli County undersheriffBy JOHN CRAMER Ravalli Republic
HAMILTON - Former Ravalli County Sheriff Perry Johnson has been named as the department's new undersheriff.He replaces Kevin McConnell, who resigned July 23 in the wake of an investigation into a domestic altercation at his home.McConnell was put on administrative leave July 18 after his wife, Angela, told 9-1-1 dispatchers that he was driving while drunk and that a physical altercation had occurred between them at their home.

McConnell's resignation was the second allegation of wrongdoing against sheriff's personnel in recent weeks.Sgt. Jeff Fowler was fired Tuesday after being put on administrative leave in connection with the theft of ammunition from the sheriff's office in June.

On Friday, the Montana Department of Criminal Investigations sent its case on Fowler to the state Attorney General's Office.Meanwhile, Johnson - who was a sheriff's detective after stepping down as sheriff - was promoted this week because of his experience, training and education and his familiarity with the sheriff's office, the community and local issues, Sheriff Chris Hoffman said.“The choice was very obvious,” Hoffman said. “Perry's qualifications for us at this time make him uniquely qualified.”Johnson said he was pleased to accept the promotion.“I like working with Chris because we have the same values,” he said.

Johnson, 52, started his law enforcement career as a sheriff's patrol deputy in 1986. He joined the Hamilton police department in 1989 as a patrol officer and later served as a detective.In 1998, he became undersheriff and served one term as sheriff from 1998 to 2002. He didn't seek re-election, saying he wanted to spend more time with his family. He endorsed Hoffman in the 2002 election.Since then, Johnson has served as a sheriff's detective, handling homicides, missing persons, embezzlement and other cases. His most prominent investigation as a detective was a triple homicide in Florence in 2001.Johnson has completed training at the FBI and other national and state law enforcement institutes.

He said his biggest challenge is reassuring the sheriff's staff that it is one of the best in the state.Johnson said he tried to persuade McConnell not to resign, but that McConnell felt stepping down was in the best interest of his family.“I admire and respect him and I understand his motives,” Johnson said. “We'll miss him terribly. He's a real positive, moral and ethical guy.

I've got some big shoes to fill.”Hoffman and Johnson said they intend to focus on moving the sheriff's office forward in addressing law enforcement issues and promoting public safety.“Choosing Perry as undersheriff will allow us to continue to provide the best service to the community,” Hoffman said.Johnson said a big challenge for the sheriff's staff will be to communicate effectively with each other, the public and media about public safety issues.

“If we don't adapt to change, we fail,” he said. “We've taken some hits recently, but we've always been supported by the community.”Missoula County Sheriff Mike McMeekin sent his case on McConnell to the state attorney general's office on Monday.In his resignation, McConnell, 44, cited personal and family reasons for leaving the sheriff's office, where he had worked since 1996.He had been undersheriff since 1992 and also served as a patrol deputy, patrol sergeant, search and rescue coordinator, deputy coroner and chief deputy coroner.Reporter John Cramer can be reached at 363-3300 or at jcramer@ravallirepublic.com.

The Montana Supreme Court in Close v. Lewis and Clark County 2008 MT 271 (August 5, 2008) detailed the method that must be used by county government in calculating deputy sheriff’s longevity pay. A review of the decision indicates the following steps should be utilized in making pay calculations for the Sheriff, Undersheriff, and Deputy Sheriffs’.

The calculations for the following examples are based on the uniform salary compensation schedule amount recommended by the County Compensation Board and approved by resolution by the Board of Commissioners for the Clerk and Recorder, Treasurer, Clerk of Court, Assessor, Superintendent of Schools, Sheriff, Surveyor, Justice of the Peace, and Auditor. The uniform amount must be the same for the Clerk and Recorder, Treasurer, Clerk of Court, Assessor, Superintendent of Schools, Sheriff, Surveyor, Justice of the Peace, and Auditor.
The Sheriff and Deputy Sheriff have 10 years of service and the Sheriff’s Office has negotiated a collective bargaining agreement with the Deputy Sheriff’s Union which provides that the minimum base annual salary for Deputy Sheriffs holding the rank of Captain shall be 80% of the salary of the Sheriff. The County Compensation Board has approved a cost-of-living-increment for the year at 2.8%

SHERIFF’S SALARY CALCULATIONS

1. Calculate the County Sheriff’s Base Salary. The uniform amount recommended by the County Compensation Board pursuant to 7-4-2503, MCA and cost- of- living increment is the County Sheriff’s Base Salary.

2. Calculate Sheriff’s Base Salary for Deputy Sheriffs and Undersheriffs Salary Calculations.

The County Sheriff’s Base Salary plus the $2000 increment provided in 7-4-2503(2)(b) MCA is the Sheriff’s Base Salary for Deputy Sheriffs and Undersheriffs Salary Calculations.

$32,840 x 95% = $31,198.

2. Calculate the Undersheriff’s Longevity. The Undersheriff’s Longevity is 1% of the Undersheriff’s Base Salary x years of service with the Sheriff’s Department adjusted annually on the anniversary date.

1% x $31,198 x 10 years = $ 3,120

3. Calculate Undersheriff’s Total Salary. The Undersheriff’s Total Salary is the Undersheriff’s Base Salary plus Undersheriff’s longevity.

$32,840 x 80% = $26,272

2. Calculate the Deputy Sheriff’s Longevity. The Deputy Sheriff’s Longevity is the Deputy Sheriff’s Base x 1% x years of service with the Sheriff’s Department.

1% x $26,272 x 10 years = $2,627

3. Calculate Deputy Sheriff’s Total Salary. The Deputy Sheriff’s Total Salary is the Deputy Sheriff’s Base Salary plus Deputy Sheriff’s Longevity.

Family Records Request Denied - Lake County Sheriff -

POLSON – A Missoula attorney says the Lake County Sheriff’s department has “stonewalled” the parents of man whose death was ruled a suicide and refuses to release any information they have requested without a court order.

On March 13, Kenneth Lee Miller died at his Swan Lake residence in what was later ruled a suicide. His parents, Clifford and Leah Miller, subsequently requested a copy of the coroner’s report and a file of the investigation into his death. Lake County Sheriff Lucky Larson refused, citing the advice of the county attorney.

In a letter to the Millers’ attorney, Larson stated he would not release the information without a district court order and would charge a series of fees for the information if a court order was obtained. The Millers’ attorney, Joan Cook, said she was surprised by the response and that obtaining a court order would likely cost the family around $10,000 in legal expenses.

“It is imperative for a family to be able to know as near as possible what happened to their loved one,” Cook said. “In this case they have been stonewalled at every turn.” Cook said her understanding is that no one from the sheriff’s department will even discuss the case with the family.

When contacted by the Montana Policy Institute, Larson said he would not answer questions over the phone and referred all inquiries to Lake County Attorney Mitch Young.

Young said state code prohibits the release of confidential criminal justice information, which is a misdemeanor for violation. He said the code is unclear about what is covered under that restriction. “In order to protect us my position is, get a court order,” Young said.

That contrasts with the way sheriffs in neighboring counties describe their standard procedure. Flathead County Sheriff Mike Meehan was asked how his department would handle a family’s request for the coroner’s report in a death that had been ruled a suicide.

“We’d give it to them,” Meehan said. “We don’t hold anything back from the family. I think the family has a right to know.”

Meehan said his department doesn’t even charge for copies in such cases. Missoula County Sheriff Mike McMeekin said he said he feels a “moral obligation” to release the coroner’s report to family members.

“If they want it, they can have it,” McMeekin said. “I feel we have an obligation to the family.” In regard to the issue about releasing confidential criminal justice information, McMeekin said he makes a clear distinction between law enforcement records and coroner reports. His department maintains completely different databases for the two, he said.

The family says one reason they want the information is to determine if there was any indication of foul play. Young said there’s no evidence to suggest that.

No inquest was held in the case. “I’m not sure why the family is not entitled to check the autopsy reports of a loved one with no explanation” as to why the request was refused, Cook said.

Cook said grieving and knowing what happened is a part of the healing that families need to go through after a catastrophic event. In this case, she said, “they’re not even able to begin that process.”

Miller’s sister, Debra West of Washington state, said the family is considering whether to pursue a court order. She said the actions to deny the family access to information surrounding her brother’s death has been “devastating” to her 85-year-old parents.

“My mother will never have any small piece of closure unless she gets those records.”


SIDEBAR: POLSON – The Lake County Sheriff’s refusal to release the coroner’s reports to the parents of a man whose death was ruled a suicide raises the larger issue of open records and uniform application of state law.

Lake County Sheriff Lucky Larson said his refusal was based on the advice of the county attorney. County Attorney Mitch Young said it is a misdemeanor to release confidential criminal justice information.

There appears to be a consensus outside Lake County that families should have access to the coroner’s report barring special circumstances. Whether a coroner’s report is legally a public record appears to be a grayer area.

Mike Meloy, attorney for the Freedom of Information Hotline in Montana, said he would argue that a coroner’s report is not a criminal justice investigative report and therefore should be considered a public record. However, he said the courts have yet to rule on that. “It’s still an open question and needs to be resolved,” Meloy said.

Missoula County Sheriff Mike McMeekin said he would provide a copy of the coroner’s report to the family in an apparent suicide case – but he doesn’t believe the report is a public record. McMeekin said he would provide it to the family out of a sense of “moral obligation.” There are exceptions, he said, such as cases where the death occurred in custody or where there was an ongoing investigation.

Similarly, Flathead County Sheriff Mike Meehan said his department would typically provide the coroner’s report to family members but might require a court order if there was an ongoing criminal investigation.

The sister of the man whose records are being held by Lake County authorities noted the apparent inconsistencies in departments across the state.

“It seems like each county is a law unto itself,” said Debra West.

Meloy said there have been three or four cases in the past year where a coroner would not release their report. However, in those cases those requesting the information did not challenge it in court.
